Terms of Use
These terms govern your use of the iPhone app Breathe In. By downloading or using the app you accept these terms. If you do not accept them, do not use the app. The license to use the app from the App Store is also governed by Apple's Standard Licensed Application End User License Agreement (EULA); if the two conflict on the license itself, the license terms of Apple's EULA apply.
1. Not medical advice
Breathe In is a tracking and motivation tool. It does not diagnose, it does not recommend treatment and it is not a medical device or a health service. The recovery information in the timeline is based on general information from the World Health Organization; it is not a personal medical assessment or a guarantee.
For quitting smoking, medication or nicotine replacement, symptoms while quitting, and anything else about your health, talk to a health professional. In an emergency, call your local emergency number (112 in Türkiye).
2. The app and your account
- Core tracking (counter, metrics, timeline, slip flow, past attempts) works without an account and is free.
- The friends leaderboard and watcher features need an account (Sign in with Apple). You are responsible for the accuracy and security of your account details.
- You must be at least 16 years old to use the app.
- You can delete your account in the app at any time (Profile > Account & Subscription). See the Privacy Policy for details.
3. Premium and subscriptions
Premium unlocks the friends leaderboard, the watcher feature, home screen visualizations and personal health thresholds. You can buy Premium as:
- Monthly subscription (1 month),
- 3-month subscription (3 months),
- Lifetime: a one-time purchase.
Prices vary by country and currency; the amount you confirm is shown in the App Store before you buy.
Auto-renewal
- Subscriptions are charged to your Apple account when you confirm the purchase.
- A subscription renews automatically for the same length and at the current price unless you cancel at least 24 hours before the end of the current period. The renewal is charged to your Apple account within 24 hours before the period ends.
- You can manage and cancel your subscription in Settings > [your name] > Subscriptions on your iPhone, or in the app under Profile > Account & Subscription > Manage subscription. Cancellation takes effect at the end of the current period and you keep Premium until then. Refunds are subject to Apple's policy and to your statutory rights (see below).
- Deleting the app or your account does not cancel a subscription; cancel it through Apple.
Introductory offer
Eligible users may be offered a discounted first month on the monthly plan. The offer can be used once per subscription group; when the offer period ends, the subscription renews at the regular monthly price. Apple determines eligibility and the exact terms are shown on the purchase screen. There is no free trial.
Changing plans
Moving from a shorter plan to a longer one (monthly to 3 months) starts immediately and Apple refunds the remaining time proportionally; moving from a longer plan to a shorter one takes effect at the end of the current period.
Lifetime purchase
The lifetime option is a single payment; it does not renew and has no end date. It unlocks Premium permanently. If Apple refunds it or the purchase is revoked, access ends.
Premium is tied to your account
Premium is tied to the Breathe In account that made the purchase and is valid only on that account. If the same Apple ID is used on another account, Premium is not granted; sign in with the account you purchased with. Use "Restore purchases" to bring back an earlier purchase.
Watchers and payment
For the watcher feature the watched person pays; being a watcher is free but needs an account. A watcher's access continues for 2 days after the watched person's Premium ends.
Refunds and complaints
Payments, refunds and billing are handled by Apple. Send refund requests to Apple at reportaproblem.apple.com. Your statutory consumer rights (for example under Turkish Consumer Protection Law No. 6502 or the consumer law of your country) are not affected by these terms.
4. Acceptable use of the social features
When using friends, the leaderboard and the watcher features, you will not:
- Harass, threaten, demean or otherwise bother another person.
- Use a fake, misleading or impersonating name or account, or an inappropriate, hateful or abusive name.
- Spam requests, notifications or share codes, or try to guess codes or make bulk attempts.
- Try to bypass or manipulate the system, points, the leaderboard or Premium checks, or harm the servers.
- Try to watch someone without their knowledge and approval. A watcher relationship is set up only with the other person's approval and is given by them of their own free will.
You can report inappropriate behavior with "Report" in the app and block the person. Reports are reviewed. We reserve the right to restrict or close accounts that break these rules without notice.
5. License and intellectual property
The app is licensed to you on a personal, non-transferable, non-exclusive and revocable basis. You will not copy, modify, reverse engineer or redistribute the app. The app's design, texts and code belong to Mehmet İlyas İnce (Miselylab). The data you enter belongs to you.
6. Disclaimer and limitation of liability
The app is provided "as is". The counter, metrics and timeline are for information and motivation; accuracy and uninterrupted operation are not guaranteed. To the extent allowed by law, we are not liable for indirect damages, loss of data, decisions you make based on information in the app, or behavior between users, and our total liability is limited to the amount you paid for the app in the last 12 months. These limits do not affect rights that applicable law does not allow to be limited (for example consumer rights).
7. Changes to the service and ending use
We may change, add or remove features. If you break these terms we may restrict your access. You may stop using the app and delete your account at any time.
8. Changes to these terms
We may update these terms. We will announce important changes in the app or on this page. If you keep using the app after a change, you accept the current terms.
9. Governing law
These terms are governed by the laws of the Republic of Türkiye; the courts and enforcement offices of Istanbul have jurisdiction over disputes. Mandatory rights you have under the consumer law of your country of residence are not affected.
